Punjab E-Challan System Faces Legal Challenge in LHC

Punjab E-Challan System Faces Legal Allegedly irregular e-challans electronic traffic tickets have been challenged in the Lahore High Court. A miscellaneous petition has been filed, expressing concern over fines imposed without proper verification of the vehicles involved. The petition, filed by Advocate Azal Siddique, alleges that flaws in the vehicle identification process are resulting in drivers being fined for traffic violations even in cases where the violations were not committed by them.

Essentially, fines for errors made by a driver are being directed to the registered owner. Furthermore, in cases where a vehicle has been sold but is subsequently misused or is being used by another individual the e-challan is still being issued to the original owner.

Gujrat Resident Challenges Five Wrong E-Challans

The petition cites the case of a resident of Gujrat, whose 2018-model vehicle was issued five ‘e-challans’ (electronic traffic violation tickets) in Lahore. In the photographs attached to these challans, the vehicle model appears to be different.

The resident claims that he was traveling from Naran to Gujrat when the alleged violations occurred; his vehicle was not even present in Lahore at the time. This indicates that individuals are receiving challans even when their vehicles were not present at the scene. A writ petition has been filed regarding this matter, and formal proceedings will commence accordingly.

Lawyer Questions E-Challan Accuracy and Heavy Fines

In another instance, it has been reported that four e-challans were issued against a lawyer’s vehicle, amounting to a total value of 11,000 rupees. The petitioner argued that relying solely on the vehicle’s make and model for identification increases the risk of erroneous fines. Furthermore, the petitioner noted that the mere appearance of a vehicle owner’s name on an e-challan does not constitute proof that the violation was independently verified.

The petition further warns that, in the event of non-payment of fines, vehicles could be impounded, and restrictions could be imposed on the transfer of ownership as well as the payment of token taxes a scenario that would create significant difficulties for the owners of these vehicles.

Regarding those who have been fined erroneously, the petitioner has urged the court to ensure transparency, accountability, proper human-level verification, and an effective mechanism to challenge incorrect traffic citations (challans). The petitioner emphasized that the purpose of technology should be to facilitate citizens, rather than to penalize them without proper, nuanced assessment.
